The following information and conditions constitute your binding
contract with Red Seal Tours. We kindly ask that you read all of
the information in this section. It provides the conditions relating
to both the services of Red Seal Tours and our suppliers. This information
should be read and understood when making a reservation. In the
chart listed below, Red Seal Tours has made it easy for you to understand
our policies for deposits, changes and/or cancellations to your
booking. Please consult with your Travel Agent if you have any questions
and/or concerns.
CREDIT CARD POLICY:
Red Seal Tours accepts Master Card, Visa, American Express and Diners/En
Route credit cards as forms of payment. If your payment is made
by credit card, please be advised that Red Seal Toronto will appear
as the vendor on your credit card statement, not your travel agency.
Your authorization to use your credit card number for payment indicates
your compliance with our booking terms and conditions, whether or
not you have actually signed the appropriate forms. In other words,
verbal authorization of your credit card confi rms your acceptance
of these terms and conditions.
BALANCE OF PAYMENT:
Full and fi nal payment is due 45 days prior to departure. Full
payment is due immediately for reservations made within 45 days
of departure. If you choose to substitute hotels not offered in
this brochure, deposit and cancellation policies will vary. Ask
your Travel Agent for details. TRAVEL TICKETS: Your Red Seal Vacations
vouchers will be faxed to your Travel Agent 21 days prior to your
booked travel dates, provided that full payment has been received
by Red Seal Vacations. In the event that you would like a hard copy
of your travel vouchers sent to your Travel Agent, a $10 fee per
fi le would be applied to your reservations
CAR RENTALS:
Car types are shown as the general vehicle in that category, but
may be substituted for a similar automobile based in the same category.
ACCOMMODATION: Please be advised that while conditions may not always
be the same as those at home, particularly with regards to electricity,
water supplies and private toilet facilities, be assured that all
properties are inspected by Red Seal Tours or its agents to ensure
acceptable standards. We reserve the right to substitute hotels
of a similar category. For a 1 & 2 night stay, surcharges apply.
CHILDREN & INFANTS:
Children and infants ages vary. Red Seal recommends that passenger(s)
consult with their Travel Agent to ensure what the applicable age(s)
and/or respective rate(s) are for child (children) travel.
REFUNDS FOR UNUSED TRAVEL SERVICES:
No refund is made for unused travel services or any portion thereof,
nor is the price or value of unused travel services exchangeable
for alternative arrangements. You are encouraged to purchase the
appropriate insurance coverage.
DOCUMENTATION:
It is the traveller’s responsibility to determine what documentation
is necessary for travel to each country. Red Seal Tours will assume
no responsibility whatsoever for passenger(s) denied carriage by
the Air Carrier, or refused entry into any country. Please contact
your Travel Agent for information.
LAWS & CUSTOMS:
In order to familiarize yourself with relevant laws and customs,
and the necessary documentation for your travel and return to Canada,
we recommend you discuss these matters with your Travel Agent who
can refer you to the relevant tourist boards, embassies or consulates
for the countries that you will be visiting.
SPECIAL REQUESTS:
Special meals or other requirements such as room location, bed preferences,
etc. must be requested at the time of booking. While Red Seal Tours
will attempt to accommodate special requests, Red Seal Tours will
not be held responsible if such requests cannot be fulfi lled.
COMPLAINTS:
Red Seal Tours has taken great care in selecting the travel suppliers
used and featured in this brochure. If you feel that the services
you received are not what you expect, please discuss your problem
with the appropriate hotel manager, car rental manager, coach tour
guide, etc. Should you remain dissatisfi ed with the service provided
and wish to comment, please write your remarks and send them to
Red Seal Tours within 30 days of the termination of the service.
Any complaints that Red Seal Tours receives after 30 days will not
be accepted.
PRICING:
Prices quoted in this brochure are in Canadian Dollars and are based
on fi xed costs at the time of printing. These costs are dependent
on fuel costs, rates of exchange and other factors. Should these
costs increase, we reserve the right to increase the cost of any
product. In the event that the increase is in excess of 7% (other
than government tax), you are entitled to cancel the travel arrangements
and receive a full refund. Every effort will be made to advise you
of any price increase at least 15 days prior to your departure date.
All prices may refl ect any administrative costs incurred.
BROCHURE PRICING:
Red Seal Tours sets its prices prior to publication based on our
costs as well as anticipated demand. The prices in this brochure
are accurate at time of printing. Red Seal Tours constantly reviews
its prices throughout the season in accordance with availability.
This brochure is effective January 2004 and supersedes any previous
publications relating to the same products. GOODS & SERVICES TAX
(GST): Since all of the products in this brochure are outside of
Canada, they are not liable for the above-mentioned tax (with exception
of airfare to the USA).
COSTS NOT INCLUDED IN TOUR:
All costs for entry visas, passports, health certifi cates and items
of a personal nature, e.g. laundry, meals not mentioned in itineraries,
telephone calls, tips, alcoholic beverages and excess baggage charges
are not included.
NOTICE TO TRAVELLERS:
Standards of living and conditions with respect to the provision
of utilities, sanitary services and the grading of services such
as hotel accommodation, vary considerably from one country to another.
HOTELS RESPONSIBILITY:
The accommodation voucher furnished by Red Seal Tours shall constitute
the sole contract between the hotels/resorts and the passenger.
The hotels and resorts depicted in this brochure will not be held
liable for any act, omission or event during the time passenger(s)
are not staying at their establishments. Neither Red Seal Tours
nor these properties are responsible for payment of any refund for
unused accommodations or meals as a result of late arrival or non-arrival
by passenger(s).
assume responsibility for any claims, losses, damages, costs or
expenses arising out of personal injury or death, loss of enjoyment,
upset, disappointment, distress or frustration, whether physical
or mental, resulting from any of the following:

Any negligent act or omission by the airlines, transportation
companies, coach tour operators, car
rental organizations, hotel/resort properties or
other suppliers or their personnel, or any company
or person not under our direct control.
02) Government actions, weather, equipment failure,
labour disputes, sickness, theft, or any other cause
beyond our direct control.
03) Failure of the passenger to obtain the necessary
documentation or health regulations to travel.
04) Failure of the passenger to arrive at the airport
in time on the day of departure, or missed connections.
05) The need for us to change itineraries
or substitute accommodation or services, provided that every
effort is made to supply the most comparable services and accommodations
available.
06) Cancellation of a tour by Red Seal Tours, provided
that full refund of all monies paid is made to the
passenger. |

only and are not a guarantee that everything will be exactly as

ACT OF GOD/FORCE MAJEURE:
Red Seal Tours and/or its suppliers cannot assume liability for
any loss, damage or injury of any nature resulting from an Act of
God or any other force majeure.
ACKNOWLEDGEMENT:
The passenger(s) hereby acknowledge(s) having read the within provisions
relating to our responsibility.
